GENERAL INFORMATION ON DATA PROCESSING
As a matter of principle, we only process your personal data if this is necessary for the provision of our offer. The data is deleted as soon as it is no longer required for the purpose for which it was collected. This is generally the case for the data used to provide the website when the respective session has ended. Your data will only be used to send you the newsletter you have subscribed to by e-mail. Your name and other necessary details are provided in order to be able to address you personally in the newsletter and, if necessary, to identify you if you wish to exercise your rights as a data subject.
When registering to receive our newsletter, the data you provide will be used exclusively for the purpose of sending the newsletter and generating leads using the Pardot tool (see below). Subscribers may also be informed by e-mail about circumstances relevant to the service or registration (e.g. changes to the newsletter offer or technical circumstances)..
For an effective registration we need a valid e-mail address. In order to verify that a registration is actually made by the owner of an e-mail address, we use the "double-opt-in" procedure. For this purpose, we log the order of the newsletter, the sending of a confirmation email and the receipt of the response requested herewith. No further data is collected. The data is used exclusively for sending the newsletter and is not passed on to third parties, except the lead generation or marketing automation provider Pardot (see below).
Legal basis
Based on your explicit consent (Art. 6 para. 1 lit. a DSGVO), we will regularly send you our newsletter or similar information by e-mail to your specified e-mail address.
You can revoke your consent to the storage of your personal data and its use for the newsletter dispatch at any time with effect for the future. You will find a corresponding link in each newsletter. CONTACT FORM
Purpose of processing:
The data you enter will be stored for the purpose of individual communication with you. This requires, among other things, the specification of a valid e-mail address and your name. These and other details are used for the assignment of the inquiry and the subsequent response as well as the leadnurturing of the same.
Legal basis:
The processing of the data entered in the contact form is based on a legitimate interest (Art. 6 para. 1 lit. f DSGVO).
By providing the contact form, we would like to enable you to contact us easily. The information you provide will be stored for the purpose of processing the request and for possible follow-up questions.
If you contact us to request a quote, the data entered in the contact form will be processed to carry out pre-contractual measures (Art. 6 para. 1 lit. b DSGVO).

Data will be deleted no later than 6 months after processing the request.
If a contractual relationship arises, we are subject to the statutory retention periods according to the German Commercial Code (HGB) and delete your data after these periods have expired.

STORAGE OF DATA VIA NEWSLETTER REGISTRATION, CONTACT, DOWNLOAD FORMS VIA PARDOT
We use the Pardot Marketing Automation System (MAS) of Salesforce.com Inc, Salesforce Tower, 415 Mission Street, 3rd Floor, San Francisco, CA 94105, USA ("Pardot") on our website. Pardot is a software module for recording and evaluating usage by website visitors, for integrating forms on our website and for planning and controlling e-mail campaigns.
Pardot is a so-called marketing automation tool linked to our Salesforce CRM system, which we use to cover various aspects of our online marketing (e.g. name, professional contact details, details of your organization and position, newsletters you have subscribed to, topic interests) as well as with information to address you individually, i.e. based on interests and usage.
If you agree to the use of Pardot, cookies will be set on your terminal device. The legal basis for this is Section 25 (1) TTDSG. Subsequent processing of data is based on your consent given to us according to Art. 6 para. 1 lit. a) DSGVO.
The cookies used by Pardot have a storage period of up to 10 years and have the purpose of throttling the request rate, identifying between users, checking whether the user has allowed the identification and preventing multiple page views of a user from being assigned to different users.
The use of Pardot results in a transfer of your data to the USA. There is no adequacy decision of the European Commission for data transfers to the USA. The data transfer takes place, among other things, on the basis of standard contractual clauses as appropriate guarantees for the protection of personal data, which we have concluded with Pardot in an order processing contract.

You can deactivate the creation of a pseudonymized usage profile at any time by configuring your browser so that cookies from the domain "pardot.com" are not accepted. However, this may result in any restrictions to the functions and user-friendliness of our website.
MAILING AND DATA STORAGE VIA PARDOT
If you have explicitly registered for our newsletter, filled out a contact form (regarding a sales inquiry or for downloading a whitepaper or similar), we use your data to send you information about new products, current offers and our customer services at regular intervals. For an effective registration we need a valid e-mail address. In order to verify that a registration is actually made by the owner of an e-mail address, we use the "double opt-in" procedure. For this purpose, we log the order of the newsletter mailing, the sending of a confirmation e-mail and the receipt of the response requested herewith. The data is used exclusively for the mailing and is not passed on to third parties. In order to provide you with information tailored to your needs, we collect other information in addition to the e-mail address, such as your company, job title or similar. You can revoke your consent to receive Germanedge mailings at any time and thus cancel the subscription via so-called unsubscribe pages and/or the notification centers, which are integrated in the respective mailings. After your cancellation, your personal data will be deleted. Your consent to the mailing will expire at the same time. At the end of each mailing from Germanedge you will find the link to cancel (unsubscribe or notification center).
The newsletter is sent using Pardot, a service provided by Salesforce.com Inc. This also allows us to merge your data with your other customer data stored with us and, if applicable, with information from third-party providers in order to address you individually, i.e. based on your interests and usage. For details on the processing of your data by Pardot and the provider Salesforce.com Inc. see the preceding paragraph. We continue to use Pardot to analyze the newsletter. For this purpose, the newsletter messages contain so-called "web beacons". These are pixel-sized files that are retrieved from the server of our service provider when the newsletter is opened. For analysis purposes, the data you provide and the "web beacons" are linked to your e-mail address and an individual ID.
The legal basis for storing information or accessing this information is Section 25 (1) TTDSG. Subsequent processing of data is based on your consent given to us according to Art. 6 para. 1 lit. a) DSGVO.
WEBSHOP / REGISTRATION
In order to use the functionalities of the web store provided on the website and to purchase licenses for the software products offered on the marketplace, you must register on the website and create a user account. To do so, the registration data requested during the registration process must be entered correctly and completely in the corresponding input mask. This includes title, first and last name, job title, company, a self-selected password and a valid e-mail address. Other information not marked as mandatory in the input mask (such as telephone number) is voluntary.
We log the registration with the data provided by you, the sending of the confirmation email and the receipt of the requested response. Further data is not collected.
After successful registration, an automatic confirmation e-mail with an activation link will be sent to the e-mail address provided during registration. Registration is not complete until the user account is activated via the link contained in the automatically sent confirmation e-mail.
The legal basis for the processing of data processed in the context of registration and the creation of user accounts is Art. 6 (1) lit. b DSGVO.
STRIPE
For payment processing in our webshop, we use the payment tool of the payment service provider Stripe. The contractual partner for customers within the EU is Stripe Payments Europe, Ltd, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland ("Stripe"). Stripe offers payment solutions for online payments. With Stripe, it is possible to make credit and debit card payments in our web store. In doing so, the entire payment process is handled by Stripe.
As part of the payment processing via Stripe, personal data of you will also be transmitted to Stripe and stored there. This is transaction data. This data includes, for example, the payment method (i.e. credit card, debit card or account number), bank code, currency, amount and date of payment. In the context of a license purchase, your name, e-mail address, billing or shipping address, and transaction history may also be transmitted. This data is necessary for authentication purposes. Furthermore, in order to prevent fraud and to be able to offer its own services in full, Stripe may also collect your name, address, telephone number and country in addition to technical data about your terminal device, such as the IP address.

Depending on which browser you use, this works in different ways. Please note, however, that the payment process may then no longer work.
Storage duration:
Personal data is generally stored for the duration of the service provision. This means that the data is stored until we terminate the cooperation with Stripe. However, if Stripe is legally obligated to do so, data may be stored beyond the duration of the cooperation.

The legal basis for the payment processing via Stripe and the data processed for this purpose is Art. 6 (1) lit. b DSGVO. The use of Stripe also requires your consent (Art. 6 para. 1 lit. a DSGVO), the use of Stripe requires the approval of cookies.
We would like to point out that the data processed via Stripe may also be processed outside the EU or the EEA, such as in the USA.
As a basis for the data transfer to third countries and the processing there, Stripe uses so-called standard contractual clauses which the European Commission has issued on the basis of Art. 46 (2) lit. c DSGVO (EU) 2021/914). GOOGLE ANALYTICS
If you have given your consent, this website uses Google Analytics 4, a web analytics service provided by Google LLC. The responsible entity for users in the EU/EEA and Switzerland is Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google").
If the user visits certain pages of our website and the cookie has not yet expired, we and Google can recognize that the user clicked on the ad and was redirected to this page. Each Google AdWords customer receives a different cookie. Cookies can therefore not be tracked across AdWords customers' websites. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. Scope of processing:
Google Analytics uses cookies that enable an analysis of your use of our website. The information collected by means of the cookies about your use of this website is usually transferred to a Google server in the USA and stored there.
We use the User ID feature. User ID allows us to assign a unique, persistent ID to one or more sessions (and the activities within those sessions) and analyze user behavior across devices.
In Google Analytics 4, the anonymization of IP addresses is activated by default. Due to IP anonymization, your IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. Third country transfer
Data is processed outside the EU/EEA and there is no level of data protection corresponding to the European standard, we have concluded EU standard contractual clauses with the service provider to establish an appropriate level of data protection. The parent company of Google Ireland, Google LLC, is based in California, USA. A transfer of data to the USA and access by US authorities to the data stored by Google cannot be ruled out. The USA is currently considered a third country from a data protection perspective. You do not have the same rights there as within the EU/EEA. You may not be entitled to any legal remedies against access by authorities.

The data sent by us and linked to cookies are automatically deleted after 3 months. The deletion of data whose retention period has been reached occurs automatically once a month.

Google Ads Conversion
We use the Google Ads Conversion offer to draw attention to our offer with the help of advertising media (so-called Google Ads) on external websites. This allows us to determine, for example, how successful our advertising campaigns are. We thus pursue the interest of showing you advertising that is of interest to you, to make our website more interesting for you.
These advertisements are delivered by Google via so-called "ad servers". For this purpose, we use ad server cookies, which can be used to measure certain parameters for measuring success, such as display of the ads or clicks by users. The controller has integrated components of PayPal on this website. PayPal is an online payment service provider. If the data subject selects "PayPal" as a payment option in our marketplace to deposit funds, data of the data subject will be automatically transmitted to PayPal. By selecting this payment option, the data subject consents to the transmission of personal data required for payment processing.
The personal data transmitted to PayPal are usually first name, last name, address, email address, IP address, phone number, cell phone number or other data that are necessary for payment processing. Also necessary for the processing of the purchase contract are such personal data that are related to the respective order.
The purpose of the transmission of the data is payment processing and fraud prevention. The controller will transfer personal data to PayPal in particular if there is a legitimate interest for the transfer. The personal data exchanged between PayPal and the controller may be transferred by PayPal to credit reporting agencies. The purpose of this transmission is to check identity and creditworthiness.

The data subject has the option to revoke the consent to the handling of personal data at any time vis-à-vis PayPal. A revocation does not affect personal data that must necessarily be processed, used or transmitted for (contractual) payment processing.

CONFLUENCE UND JIRA
We use the collaboration tool Confluence and the project management tool Jira for our website. The service provider in each case is the American company Atlassian Inc., 1098 Harrison Street, San Francisco, California 94103, USA ("Atlassian").
Confluence and Jira also process data from you in the USA, among other places. We would like to point out that according to the opinion of the European Court of Justice, there is currently no adequate level of protection for the transfer of data to the USA, which may entail various risks for the legality and security of the data processing.
As a basis for the data transfer to third countries and the processing there, Atlassian uses so-called standard contractual clauses for Confluence and Jira which the European Commission has issued on the basis of Art. 46 para. 2 lit. c DSGVO (EU) 2021/914). The standard contractual clauses are intended to ensure that your data comply with European data protection standards even if they are transferred to third countries (such as the USA) and processed there. Through these clauses, Atlassian undertakes to comply with the European level of data protection when processing your relevant data, even if the data is processed in the US. In order to be able to conduct webinars via the Internet, Germanedge uses the software solution GoToWebinar from LogMeIn, Inc. 333 Summer Street, Boston, MA 02210 USA. LogMeIn, Inc. is the data controller for the provision of this service and the associated data processing. LogMeIn's privacy policy can be found here. For the implementation of the webinar, we transmit your registration or customer data to LogMeIn, Inc. The processing of your data is based on your consent (Article 6 para 1 lit. a DSGVO). For the execution of the webinar, an encrypted connection is established between you and the organizer of the webinar. The webinars are regularly recorded in order to make them available on our website for later retrieval ("Webinar On Demand"). However, there is no transparency or inference about the participants of a webinar; likewise, the written chat used is not published. The questions asked by the participants during the webinar and the corresponding answers are therefore not recorded and stored. Statistical data is collected during and after the webinar. If you participate in a webinar, in addition to your registration data we receive information about the duration of participation, interest in the webinar, questions asked or answers given for the purpose of further customer support or to enhance the user experience.

Right of objection
If your personal data is processed on the basis of legitimate interests pursuant to Art. 6(1)(f) DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, provided that there are grounds for doing so that arise from your particular situation. Your personal data will then no longer be processed unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the assertion or defense of legal claims.
Right to rectification
You have the right to rectification and/or completion if your personal data processed by us is incorrect or incomplete. Should this be the case, we will make the correction without delay.
Right to restriction of processing
You may request the restriction of the processing of your personal data under the following conditions:
- (a) if you dispute the accuracy of your personal data for a period of time that allows us to verify the accuracy;
- (b) the processing is unlawful and you object to the erasure of your personal data and request instead the restriction of the use of the personal data;
- (c) we no longer need your personal data for the purposes of processing, but you need them for the assertion, exercise or defense of legal claims, or
- (d) if you have objected to the processing pursuant to Art. 21 (1) DSGVO and it has not yet been determined whether our legitimate grounds as controller outweigh your grounds as data subject.
If the processing of your personal data has been restricted, these data - apart from their storage - may only be processed with your consent or for the assertion, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the Union or a Member State.
If the restriction of processing has been restricted in accordance with the above conditions, we will inform you of this before the restriction is lifted.
Right to deletion
Obligation to delete: You may request that we delete your personal data without undue delay, provided that one of the following reasons applies:
- (a) Your personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
- (b) if the processing was based on Art. 6 para. 1 lit. a DSGVO or § 25 para. 1 TTDSG, you revoke your consent and there is no other legal basis for the processing;
- (c) you object to the processing pursuant to Art. 21 (1) DSGVO and there are no overriding legitimate grounds for the processing, or you object to the use of your personal data for advertising purposes pursuant to Art. 21 (2) DSGVO;
- (d) your personal data have been processed unlawfully;
- (e) the deletion of your personal data is necessary for the fulfillment of a legal obligation.
Exceptions
- (a) The right to erasure does not exist to the extent that the processing is necessary
- (b) on the exercise of the right to freedom of expression and information;
- (c) to fulfill a legal obligation or to perform a task that is in the public interest;
- (d) for the assertion, exercise or defense of legal claims.
Right to complain to a supervisory authority
Without prejudice to any other remedies, you have the right to lodge a complaint with a competent supervisory authority if you consider that the processing of your personal data infringes the GDPR.
